Terms of Service

01 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Tigerbyte Solutions ("we," "us," or "our") governing your access to and use of the Framee mobile application, website at framee.app, and all related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately stop using the Platform.

02 Eligibility

To use the Platform, you must meet the following requirements:

• You must be 13 years of age or older to create an account and use the Platform. You must be 18 years of age or older to access AI content generation features or purchase tokens
• You must have the legal capacity to enter into a binding agreement in your jurisdiction
• You must not have been previously banned or had your account terminated by us

If we discover that a user is under 13, their account will be terminated immediately and any associated data will be deleted in accordance with our Privacy Policy. Users between 13 and 17 may use the Platform but will not have access to AI generation or token purchases.

03 Account Registration & Security

You may create a Framee account using one of the following methods:

• Email and password — Register with your email address and a secure password
• Google OAuth — Sign in using your Google account
• Facebook Login — Sign in using your Facebook account

When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account
• Maintain only one account per person — creating multiple accounts is prohibited

We reserve the right to suspend or terminate accounts that violate these requirements.

04 The Service

Framee is an AI-powered platform that enables users to create, share, and discover AI-generated images and videos. The Platform includes the following core features:

The availability, features, and supported AI engines on the Platform may change at any time without prior notice.

05 Tokens & Payments

AI content generation on Framee requires tokens, a virtual currency used exclusively within the Platform.

Purchasing Tokens

• Token packages are available for purchase through Stripe (web), Apple App Store (iOS), or Google Play (Android)
• Prices are displayed at the time of purchase and may vary by payment method and region
• We reserve the right to modify token package pricing with reasonable notice

Token Usage & Refunds

• Tokens are consumed when you initiate an AI generation request
• If a generation fails due to a platform error, tokens may be refunded to your account at our discretion
• All purchases are final and non-refundable, except as required by applicable law or the refund policies of Apple App Store or Google Play
• Tokens have no monetary value, cannot be exchanged for cash, and are non-transferable between accounts
• Unused tokens remain in your account until used or until your account is terminated

06 AI-Generated Content & Intellectual Property

Your Content

• You retain all rights to your original text prompts, reference images, and any other materials you upload to the Platform
• You receive a license to use, download, and share AI-generated content created through your use of the Platform for personal and commercial purposes, subject to these Terms
• You are solely responsible for ensuring that your prompts and uploaded materials do not infringe upon the intellectual property rights of any third party

License to Framee

• By publishing content to the social feed, you grant Framee a worldwide, non-exclusive, royalty-free license to display, distribute, reproduce, and promote your content on the Platform and in marketing materials
• This license exists for as long as your content remains published on the Platform and terminates when you remove the content or delete your account
• Framee does not claim ownership of your content

Remix & Derivative Works

• If you enable the remix feature on your published content, you grant other users permission to create derivative works based on your content
• Remixed content will be attributed to both the original creator and the remixer
• You may disable the remix feature on your content at any time, though existing remixes will not be removed

Framee Intellectual Property

The Framee name, logo, branding, user interface, software, and all related intellectual property are owned by Tigerbyte Solutions and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

07 User Conduct & Prohibited Content

You agree to use the Platform responsibly and in compliance with all applicable laws. The following activities are strictly prohibited:

Prohibited Content

• Generating, uploading, or sharing illegal content of any kind
• Child sexual abuse material (CSAM) or any content sexualizing minors
• Non-consensual intimate imagery, including AI-generated depictions of real individuals
• Generating deepfakes or realistic depictions of real people without their explicit consent
• Content that promotes terrorism, violence, or self-harm
• Hate speech, harassment, bullying, or threats directed at individuals or groups

Prohibited Behavior

• Attempting to bypass, circumvent, or disable content safety filters or moderation systems
• Impersonating other individuals, creators, or Framee staff
• Spamming, including automated or bulk generation of content, comments, or follows
• Using bots, scrapers, or automated tools to access or interact with the Platform
• Scraping, data mining, or harvesting user data or content from the Platform
• Uploading malware, viruses, or exploiting security vulnerabilities in the Platform
• Reselling, redistributing, or sublicensing access to the Platform or tokens
• Creating multiple accounts to evade bans or manipulate engagement metrics

All content submitted to the Platform is subject to automated content safety screening. We reserve the right to remove any content that violates these Terms or our community standards without notice.

08 Content Moderation & Enforcement

We are committed to maintaining a safe and respectful platform. Our moderation approach includes:

• Automated screening — All AI-generated content is processed through automated content safety systems before being made available
• User reporting — Any user can report content or other users for violating these Terms or community standards
• Human review — Reported content is reviewed by our team, and appropriate action is taken based on the severity of the violation

Enforcement Actions

Depending on the nature and severity of a violation, we may take one or more of the following actions:

• Remove the offending content
• Issue a warning to your account
• Temporarily suspend your account
• Permanently terminate your account
• Apply restrictions to your account
• Report illegal activity to the appropriate authorities

If you believe enforcement action was taken against your account in error, you may submit an appeal by contacting us at legal@framee.app.

09 Social Features

The Platform includes social features that allow you to interact with other users and their content:

• Following — Follow other creators to see their content in your feed
• Engagement — Like, comment on, share, and save content from other creators
• Remixing — Create derivative works from other users' content when they have enabled the remix feature
• Blocking & Reporting — Block users you do not wish to interact with and report content or users who violate these Terms
• Profile visibility — Your public profile, including your username, display name, bio, and published content, is visible to all Platform users. You may set your profile to private to limit visibility
• Share links — When you share content via links, those links may track click counts for analytics purposes

You are responsible for the content of your comments and social interactions on the Platform. Abusive, harassing, or spammy behavior will result in enforcement action as described in Section 8.

10 Third-Party Services

The Platform integrates with third-party services to deliver its features, including AI generation providers, payment processors, cloud storage, and authentication services. You acknowledge and agree that:

• We are not responsible for the availability, performance, or policies of third-party services
• AI generation quality, speed, and availability depend on third-party providers and may vary or be temporarily unavailable
• AI models and providers may be added, changed, or removed at any time without notice
• In-app purchases made through the Apple App Store or Google Play are subject to the respective platform's terms and refund policies
• Your use of social sign-in (Google, Facebook) is subject to those providers' terms of service and privacy policies

11 Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, TIGERBYTE SOLUTIONS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Quality of AI output — We do not guarantee the quality, accuracy, appropriateness, or fitness for any particular purpose of AI-generated images or videos. Results may contain artifacts, errors, or unexpected content
• Availability — We do not guarantee uninterrupted, error-free, or secure access to the Platform. Service disruptions may occur due to maintenance, updates, or circumstances beyond our control
• AI model availability — Specific AI models and providers may be changed, updated, or discontinued without notice
• Content accuracy — AI-generated content may not accurately represent real people, places, events, or facts
• Third-party services — We are not responsible for outages, errors, or changes to third-party services integrated with the Platform

12 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Tigerbyte Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, goodwill, or other intangible losses
• Our total aggregate liability for any claims arising out of or relating to these Terms or the Platform shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim
• We are not liable for the content, quality, or effects of AI-generated images or videos, or for the actions, content, or conduct of other users on the Platform
• We are not liable for any damages resulting from your reliance on AI-generated content or your inability to use the Platform

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

13 Indemnification

You agree to indemnify, defend, and hold harmless Tigerbyte Solutions, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Platform or any content you generate, upload, publish, or share
• Your violation of these Terms or any applicable law or regulation
• Your infringement of any third-party intellectual property, privacy, or other rights
• Any dispute between you and another user of the Platform

14 Termination

Termination by You

You may request deletion of your account at any time by contacting us at privacy@framee.app. We will process your request within 30 days. Upon deletion, your profile, published content, and associated data will be removed in accordance with our Privacy Policy.

Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our community standards
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion if we believe your account poses a risk to the Platform or other users

Effect of Termination

• Upon termination, your right to access and use the Platform ceases immediately
• Any unused tokens in your account will be forfeited and are not refundable
• Access to your AI-generated content may be permanently lost
• Sections 6 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 16 (Governing Law) shall survive termination

15 Changes to Terms

We may revise these Terms from time to time at our sole discretion. When we make changes:

• The "Last Updated" date at the top of this page will be revised
• For material changes, we will notify you via email or an in-app notification at least 30 days before the changes take effect
• Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes

If you do not agree to the revised Terms, you must stop using the Platform and request account deletion before the changes take effect.

16 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

• Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved through binding arbitration administered in accordance with applicable arbitration rules, except where prohibited by law
• Arbitration shall be conducted on an individual basis. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration
• Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
